1. Overview
Bitwise Consulting LLC ("Company," "we," "us") provides professional e-commerce consulting services. Due to the nature of professional services — which involve the investment of time, expertise, and resources — our refund policy is structured to be fair to both parties while reflecting the realities of knowledge-based work.
Please read this Refund Policy carefully before engaging our services. By proceeding with a purchase or service engagement, you acknowledge and agree to the terms described herein.
2. Non-Refundable Services
The following are generally non-refundable:
- Completed Deliverables: Any work product that has been delivered, accepted, or used by the Client.
- Retainer Fees: Monthly retainer fees for ongoing services, once a billing cycle has commenced.
- Discovery and Audit Services: Fees for discovery sessions, audits, and strategy workshops, as these result in the immediate creation and delivery of intellectual work product.
- Third-Party Costs: Any expenses incurred on your behalf with third-party vendors, platforms, or service providers (e.g., ad spend, platform fees, software licenses).
- Rush or Expedited Service Fees: Any premium paid for prioritized or expedited delivery.
3. Cancellation of Ongoing Services
For ongoing monthly services or retainer arrangements:
- Either party may terminate ongoing services by providing thirty (30) days written notice to the other party.
- You will be invoiced for all work performed up to the effective date of cancellation.
- Prepaid fees for the current billing period are non-refundable. Prepaid fees for future billing periods (if applicable) may be refunded on a pro-rated basis.
- Cancellations must be submitted in writing to contact@bitwiseconsulting.top.
4. Project-Based Services
For fixed-scope project engagements:
- Before Work Commences: If you cancel within 48 hours of signing a Statement of Work and before any work has commenced, you may be entitled to a full refund of any deposit paid, minus an administrative fee of $150.
- During Active Work: If you cancel after work has commenced, you will be charged for all work completed to date at our standard hourly rates, plus any committed third-party expenses. Any remaining balance from a deposit will be refunded after these charges are deducted.
- After Delivery: No refunds are available after final deliverables have been provided.
5. Satisfaction Guarantee
We are committed to delivering quality work. If you are not satisfied with a specific deliverable:
- You must notify us in writing within ten (10) business days of delivery, specifying the nature of the concern.
- We will work with you in good faith to revise the deliverable in accordance with the original agreed scope at no additional charge (subject to revision limits outlined in the applicable SOW).
- Satisfaction remedies are limited to revision of work product and do not automatically entitle you to a monetary refund.
6. Billing Disputes
If you believe you have been incorrectly charged:
- You must notify us in writing at contact@bitwiseconsulting.top within thirty (30) days of the invoice date.
- Disputes not raised within thirty (30) days are deemed accepted.
- We will investigate all disputes promptly and respond within ten (10) business days.
- If a billing error is confirmed, we will issue a credit or refund within fourteen (14) business days.
7. Chargebacks
We ask that you contact us directly to resolve any billing concerns before initiating a chargeback with your bank or credit card provider. Initiating an unwarranted chargeback may result in suspension of services, a chargeback dispute fee, and potential legal action to recover amounts owed. We reserve all rights to contest unwarranted chargebacks.
8. Refund Processing
Approved refunds will be processed using the same payment method used for the original transaction, within fourteen (14) business days of approval. Processing times may vary depending on your bank or payment provider. We are not responsible for delays caused by financial institutions.
9. Exceptions
We recognize that unusual circumstances arise. All refund requests outside the parameters above will be reviewed on a case-by-case basis at our sole discretion. To request an exception, please contact us at contact@bitwiseconsulting.top with a full explanation of your situation.
